Terms of Service
These Terms govern access to and use of Noticer websites, products, verification services, and related features. By using the service, you agree to these Terms.
What Noticer does
Noticer evaluates evidence about a defined claim or required outcome and may record a result such as PROVED, DISPROVED, or INCONCLUSIVE. A Noticer result reflects the evidence and verification contract available for that check. It is not a promise that every relevant fact in the world has been observed.
Your responsibility
You are responsible for the claims, requirements, accounts, integrations, permissions, and information you provide. You must have authority to connect or inspect any system you ask Noticer to access. You remain responsible for decisions made using Noticer results.
Inconclusive results and limitations
Evidence can be unavailable, delayed, contradictory, incomplete, or inaccessible. INCONCLUSIVE is a valid result. Noticer may refuse to claim certainty when the available evidence does not support it. Verification does not replace professional, legal, financial, medical, safety, compliance, or security advice.
Third-party services
Noticer may interact with third-party products and services. Those services are controlled by their respective providers and may change, fail, restrict access, or impose separate terms. Noticer is not responsible for third-party services outside its control.
Acceptable use
You may not use Noticer to access systems without authorization, violate law, interfere with services, evade access controls, harm others, misrepresent evidence, or use the service for abusive surveillance or other prohibited activity.
Accounts and availability
You are responsible for protecting your account credentials. We may change, suspend, limit, or discontinue features when reasonably necessary for security, integrity, legal compliance, maintenance, or product development.
Paid services
If you purchase a paid service, the price and applicable billing terms presented at purchase are part of these Terms. Except where required by law or explicitly stated otherwise, fees for completed checks or delivered services are not refundable merely because the evidence supports an unfavorable or inconclusive result.
Intellectual property
Noticer and its underlying software, design, verification methods, and service materials are protected by applicable intellectual-property laws. You retain rights to content you provide. You grant Noticer the permissions reasonably necessary to process that content and produce the service you request.
Disclaimers
The service is provided on an “as available” basis to the extent permitted by law. We do not guarantee uninterrupted operation, universal observability, or that every error, omission, or false success can be detected.
Limitation of liability
To the fullest extent permitted by law, Noticer will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising from use of the service. Any liability that cannot lawfully be excluded will be limited to the extent permitted by applicable law.
Changes
We may update these Terms as the service changes. Continued use after updated Terms become effective constitutes acceptance of the revised Terms where permitted by law.
Governing law
These Terms are governed by the laws applicable to the operator of Noticer in Minnesota, United States, without regard to conflict-of-law principles, except where mandatory consumer law provides otherwise.
